SDOT has announced its intent not to appeal the April 16 Superior Court ruling concerning the challenge to environmental determination on this segment of the BGT. However, we hear that it is quite possible that the original appealing individuals and orgs may choose to appeal the Court’s ruling which denied seven of the eight issues where they found fault with SDOT’s original EA which was backed up by an appeal to the Hearing Examiner.

The Ballard DC although mostly supportive of the BGT proposal; has avoided taking a formal position on the issue mostly because several of their participating organizations find fault with the proposed alignment and its assumed impact .

However, most folks out here are anxious to know how SDOT plans to proceed and by when. Moreover, until the legal challenge is resolved and work begins to construct the planned “missing link”; perhaps other short term safety enhancements should be implemented by SDOT.
